Terms of Service for FlipperPic

Please read these Terms of Service ("Terms") carefully before using the FlipperPic mobile application (the "Service") operated by TeraTastic LLC ("us", "we", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the Service.

1. Use of the App

License: We grant you a personal, non-exclusive, non-transferable, revocable license to use FlipperPic on your personal mobile devices in accordance with these Terms.

Restrictions: You agree not to:

  • Modify, reverse-engineer, decompile, or disassemble the Service.
  • Use the Service in any way that violates applicable local, national, or international laws.
  • Use the Service to display or transmit illicit, offensive, or illegal content.

2. User Content & Media

Ownership: You retain full ownership of all photos, videos, and media ("User Content") that you view, organize, or manage using FlipperPic. We do not claim any ownership rights over your User Content.

Responsibility: You are solely responsible for the media you choose to view, organize, or cast to external displays using FlipperPic. Because FlipperPic processes your media locally on your device, we cannot monitor, control, or take responsibility for your User Content.

3. FlipperPic Pro & In-App Purchases

FlipperPic offers an optional premium upgrade ("FlipperPic Pro") which unlocks additional features such as TV casting and advanced collage tools.

  • Billing: If you choose to upgrade to FlipperPic Pro, the transaction is handled entirely by the Google Play Store. We do not collect or store your credit card information.
  • Refunds: Any requests for refunds must be directed to Google Play according to their standard refund policies.
  • Changes to Pricing: We reserve the right to change the price of FlipperPic Pro at any time. Any price changes will not affect past purchases.

4. Google Drive Backups

FlipperPic offers an optional feature to back up your curation metadata (such as ratings, tags, and albums) to your personal Google Drive account.

  • We do not provide cloud storage. This feature relies entirely on your personal Google Drive account and storage quota.
  • We are not responsible for any data loss, corruption, or syncing issues that may occur between your device and your Google Drive account.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TeraTastic LLC. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We provide no warranties, whether express or implied, regarding the reliability, accuracy, or performance of the Service.

Specifically, we do not guarantee that:

  • The Service will function uninterrupted or be available at any particular time or location.
  • The casting features will be compatible with all TVs, routers, or streaming devices.
  • Any errors or defects will be corrected immediately.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TeraTastic LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any unauthorized access, use, or alteration of your transmissions or content.
  • Any loss of photo metadata, curation data, or device malfunction during the use of the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
